Titans Product Design Ltd – B2B Terms and Conditions

These terms and conditions ("Terms") apply to all business-to-business transactions between Titans Product Design Ltd ("TPD", "we", "our") and the Customer ("you", "your") and supersede any other agreements unless otherwise explicitly agreed in writing.

1. Order Confirmation & Lead Times

All dispatch or delivery dates provided are estimates and targets only, based on the date of order confirmation. TPD does not guarantee delivery dates, and any delays shall not entitle the Customer to any claims, damages, or cancellation.

2. Right to Cancel & Cancellation Fees

TPD reserves the unconditional right to cancel any order at any time and shall refund the Customer in full upon cancellation. The Customer may cancel an order; however, a cancellation fee equal to 50% of the order value shall apply. TPD may waive this fee at its sole discretion.

3. Intellectual Property (IP) and Usage

The Customer warrants that it has obtained all necessary rights and permissions to manufacture or commission TPD to manufacture products from files provided. TPD accepts no liability for any infringement of third-party IP rights by products produced from customer-supplied files. TPD does not claim ownership or rights over the Customer’s supplied files and will not produce products from these files for any third party.

Original designs created by TPD remain the intellectual property of TPD unless explicitly stated otherwise. TPD retains full rights to utilise, modify, distribute, or otherwise exploit such designs as it sees fit, unless an NDA or separate written agreement specifically overrides this clause.

4. Returns Policy

At Titan’s Product Design, we want every customer to be delighted with their purchase. All models and parts are carefully inspected before dispatch to ensure they meet our high standards of quality and accuracy.

If you are not completely satisfied, please contact us within 14 days of delivery so we can help resolve the issue. Returns are accepted in line with eBay’s policies under the following conditions:

• Items must be returned in their original, unused condition.

• Buyers are responsible for return postage unless the item is faulty or damaged.

• Refunds will be issued once the returned goods have been received and inspected.

As many of our products are made to order, returns for change of mind may not always be possible. However, if there is any problem with print quality, missing parts, or damage during transit, we will offer a replacement or full refund as appropriate.

Please contact us through eBay messages before returning any item so we can provide the correct return address and guidance.

5. Delivery Terms

Products will be shipped via Royal Mail 2nd Class Signed For unless otherwise agreed. The Customer may request an alternative delivery method at their own cost or arrange independent collection with prior written agreement from TPD.

6. Payment Terms

Invoices are payable in full by the end of the calendar month in which they are issued. Payments must be made via bank transfer or Stripe invoice. Production will not commence until payment (for proforma invoices) or an official purchase order is received. Late payment may delay the estimated dispatch date. Late payments will incur interest charges at 8% above the Bank of England base rate per annum, as stipulated in The Late Payment of Commercial Debts (Interest) Act 1998. Additionally, any costs incurred by TPD in recovering outstanding payments (in time or expense) may be charged to and recovered from the Customer.

7. Liability Limitations

TPD’s liability arising from or relating to any transaction is strictly limited to the value of the contract (excluding delivery charges). Under no circumstances shall TPD be liable for any indirect, consequential, or special damages or losses.

8. Force Majeure

TPD shall not be liable for delays or failure to deliver products due to circumstances beyond its reasonable control, including but not limited to acts of nature, strikes, material shortages, or technical failures.

9. Acceptance of Terms

Placement of an order constitutes acceptance of these Terms by the Customer. Amendments or alterations to these Terms shall only be binding if expressly agreed in writing by both parties.

10. Governing Law

These Terms and all transactions shall be governed exclusively by English law, and disputes shall be subject to the jurisdiction of English courts.

11. Data Privacy Policy

At Titan’s Product Design, we value your privacy and are committed to handling your personal data responsibly and securely. We comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Information We Collect
When you make a purchase through eBay, we receive limited personal information required to fulfil your order — such as your name, delivery address, email address, and order details.

How We Use Your Information
Your information is used solely to:

• Process and dispatch your order.

12. Terms of Service — Titan’s Product Design

By purchasing from Titan’s Product Design, you agree to the following terms and conditions:

1. Products & Orders
All models are produced to a high professional standard using precision 3D printing technology. Many items are made to order, and slight variations in colour or finish may occur due to the nature of resin printing. We reserve the right to update product designs or specifications without notice to improve quality.

2. Payment & Pricing
All prices are listed in GBP (£) and include applicable taxes. Payment is required in full at the time of purchase via eBay’s checkout system. Custom requests, upgrades, or special commissions may incur additional costs, which will be agreed upon in advance.

3. Dispatch & Delivery
We aim to dispatch all in-stock items within 1–2 working days of cleared payment. Made-to-order items may require additional processing time. Delivery times vary depending on location and postal service. See our Postage Policy for full details.

4. Returns & Refunds
If you are not completely satisfied with your purchase, please contact us within 14 days of delivery. Returns are accepted in line with eBay policy provided items are unused and in their original condition. See our Returns Policy for details.

5. Custom Orders
For bespoke or personalised commissions, payment terms and lead times will be confirmed before production begins. Once manufacturing has started, cancellations or refunds may not be possible unless the product is defective.

6. Intellectual Property
All designs, models, and digital files sold by Titan’s Product Design remain the intellectual property of Titan’s Product Design Ltd unless otherwise agreed in writing. Reproduction, resale, or redistribution of our designs without permission is strictly prohibited.

7. Liability
We take care to ensure all products meet high safety and quality standards. However, Titan’s Product Design cannot be held liable for damage or loss resulting from misuse, modification, or improper assembly of our products. Our liability shall not exceed the purchase price of the item.
